1. Definitions
In these Terms and Conditions, the following terms have the meanings stated below:
EXCLV.: The commercial name of the company Passion for Exclusive, with registered office at Donklaan 253 bus 1002 – 9290 Berlare registered under
KBO number BE1027.816.651
Website: www.exclv.be and all subpages.
Customer: Any natural person or legal entity who purchases goods through the Website.
Seller/Consignment Partner: Any natural person or legal entity that consigns goods to EXCLV.
Parties: EXCLV. and the Customer or Seller together.
2. Applicability
2.1. These General Terms and Conditions apply to all transactions and agreements between EXCLV. and its customers and sellers via the Website.
2.2. By using the Website and/or placing an order or submitting a consignment form, the user fully and unconditionally accepts these General Terms and Conditions.
2.3. Any deviations from these conditions are only valid if explicitly agreed upon in writing.
3. Product Information and Availability
3.1. EXCLV. strives to present information on the Website as accurately and up to date as possible, including photos, prices, and product descriptions.
3.2. EXCLV. reserves the right to refuse, correct, modify, or remove products if information is incorrect.
3.3. Availability may vary; once a product has been sold, it will automatically be marked as unavailable.
4. Orders & Payment
4.1. Orders are binding once the Customer places an order and the payment has been processed.
4.2. Payment can be made via the secure payment methods offered on the Website.
4.3. EXCLV. reserves the right to cancel an order if payment is not correctly or timely completed.
5. Consignment Sales
5.1. For all goods sold on consignment, the EXCLV. Consignment Terms apply, which form an integral part of these General Terms and Conditions.
5.2. The consignment terms govern the relationship between EXCLV. and the Seller, including sale, compensation, liability, and termination.
6. Prices & Shipping Costs
6.1. All prices on the Website are in euros (€) and include VAT, unless expressly stated otherwise.
6.2. Shipping costs are stated separately and added to the order at checkout.
6.3. EXCLV. reserves the right to change prices without prior notice, except for orders already placed.
7. Delivery
7.1. EXCLV. aims to deliver orders within the indicated timeframe. Delivery times are indicative and not guaranteed.
7.2. Delayed delivery does not entitle the Customer to terminate the agreement, claim reimbursement of costs, or seek damages, except where legally required.
7.3. Risk transfers to the Customer once the product has been delivered to the carrier.
8. Withdrawal & Returns
8.1. Customers have the right to cancel their purchase within 14 days of receipt, in accordance with EXCLV.’s Privacy and Return Policy.
8.2. Goods must be returned unused and complete with labels and original packaging.
8.3. Improper returns will not be accepted or may be partially refunded. For the full procedure, please refer to the Return and Refund Policy.
9. Liability
9.1. EXCLV. strives to provide accurate services and careful handling of goods and data.
9.2. Subject to mandatory legal provisions, EXCLV. shall not be liable for indirect damage, consequential damage, loss of profit, or depreciation in value.
9.3. The maximum liability of EXCLV. is limited to the purchase amount of the relevant good.
9.4. EXCLV. is not liable for damage caused by negligence of the Customer or Seller.
10. Intellectual Property
10.1. All content on the Website (texts, images, logos, trademarks) is protected by intellectual property rights.
10.2. Use of this content without explicit permission is prohibited.
11. Privacy & Data Protection
11.1. Personal data is processed in accordance with EXCLV.’s Privacy Policy.
11.2. By using the Website and services, you agree to the processing of your data as described in the Privacy Policy.
12. Amendments to These Terms
12.1. EXCLV. reserves the right to amend these General Terms and Conditions.
12.2. Amendments will be published on the Website and apply from the date of publication.
12.3. By continuing to access the Website and services after publication of the amended terms, you agree to the new terms.
13. Governing Law and Disputes
13.1. These General Terms and Conditions are governed exclusively by Belgian law.
13.2. In the event of a dispute, the Parties shall seek an amicable settlement.
13.3. If no amicable settlement is possible, the courts of the judicial district where EXCLV. has its registered office shall have jurisdiction.
